These Terms of Sale govern purchases from TrueBac Water (“we”, “us”) through truebacwater.com. By placing an order you agree to these terms, our Research Use Policy, and, for standing orders, our Subscription Terms.
1. Eligibility and research use
You must be at least 21 years old and purchasing on behalf of yourself or an organization for legitimate laboratory research, analytical, industrial or educational purposes. All products are laboratory reagents sold for research use only. They are not drugs, have not been evaluated or approved by the U.S. Food and Drug Administration for any purpose, and are not for human or veterinary use. You agree not to use, resell or supply any product for such use.
2. Orders and acceptance
An order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, including after payment, where we believe it is inconsistent with the Research Use Policy, appears fraudulent, or cannot be fulfilled; in that case we refund any amount charged.
3. Prices, taxes and payment
Prices are in U.S. dollars. Applicable sales tax is calculated at checkout. Payment is processed by Stripe; we do not receive or store your full card details.
4. Shipping and risk
We ship to U.S. addresses only. Title and risk of loss pass to you on delivery to the carrier. See Shipping & Returns.
5. Product information and limited warranty
We warrant that each unit, on delivery, is from a lot whose independent laboratory report conformed to our published specification. Product information on this site describes the product as a laboratory reagent and is not advice regarding any use. Except for this limited warranty, products are provided “as is”, and we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose, to the extent permitted by law. Your remedy for breach of warranty is replacement or refund of the affected units.
6. Limitation of liability
To the extent permitted by law, our total liability arising from any order is limited to the amount you paid for it, and we are not liable for indirect, incidental or consequential damages. Nothing in these terms limits liability that cannot be limited by law.
7. Indemnity
You agree to indemnify us against claims arising from your use of a product in breach of these terms or the Research Use Policy, including any human or veterinary use.
8. Governing law
These terms are governed by the laws of the state in which TrueBac Water is organized, without regard to conflict-of-laws rules.
